Dr. Julie Reyes combines both Eastern and Western perspectives to provide truly holistic care for her patients. As a gentle-touch Chiropractor, she promotes total body wellness for the whole family. We have unfortunately seen quite a few patients lately who have been in car accidents both minor and major. We would like to address some of the most common questions we receive when one of our patients gets into an auto accident, regardless of fault.  We never want to think about getting into an accident, but it is always better to be prepared and informed. You’ve been in an auto accident.  Now what?

Unless the damages are minimal, file a police report and do not move your car until the police arrive to the scene.  If damages are minimal, take several photos (using your cell phone) of both vehicles (zoom in on the license plate), the surroundings (from many angles), the other drivers driver’s license and insurance card (front and back).  Having a photo of these cards will verify the information the other driver gives you is correct.  Be sure to get their address and phone numbers as well.

If any witnesses have stopped to offer assistance, be sure to get their names, addresses and phone numbers.  If the police have been called to the scene to take a report, you should still get this information on your own.

If you have been injured, it is very important you seek medical attention immediately.  Symptoms do not always appear right away

We suggest keeping a diary that includes your symptoms every day and how they have affected your day.  Did you miss work?  Were you unable to care for your children?  Have you been forced to stop your exercise routine?  Also, it’s important to note conversations with repair facilities and insurance adjustors.

Keep a file of all letters, invoices and bills related to the accident.

 

What about insurance?

If you, or any of your passengers, are injured in an automobile accident in California, whether it is your fault, or the other driver's fault, your insurance with Med Pay coverage will be responsible for paying all of your (and your passenger's) reasonable and necessary medical bills. 

Medical Pay Benefits coverage is simply known as "Med Pay" and it is additional coverage that attaches to an individual's automobile policy. This additional policy must be requested by the policy holder.  It is not a required benefit in California.  Med Pay policies coverage limits that are generally in amounts of $1,000.00; $2,000.00; $5,000.00; $10,000.00; $25,000.00; and $100,000.00.

Patients are often hesitant to use this benefit coverage because they worry their insurance rates will go up; however, insurance companies cannot raise your insurance rates for utilizing your insurance benefits, including Med Pay coverage, if you were NOT AT FAULT in an automobile accident; however, Med Pay coverage applies REGARDLESS OF FAULT.

Med Pay policies do have some restrictions.  The medical care must be for symptoms of an injury related to the accident and must be considered medically necessary.  Some policies are excess only policies that will cover after your health insurance has been billed, and some do have deductibles attached to them.  Although this is rare.  We recommend that you use your Med Pay coverage for things that are not paid by your health insurance, like chiropractic bills or other alternative care. 

Here are a few scenarios where medical payments coverage may kick in to help cover expenses:

  • Passengers are hurt while you or a family member is driving
  • You're injured as a passenger in someone else's car
  • You're struck by a car while walking or cycling
  • You require dental care after an accident
  • You require extended nursing services or hospitalization while rehabilitating
  • You require prosthetic limbs
